These Terms of Service ("Terms") govern your use of the Gogaku mobile application (the "App"), operated by Philomath Tech LLC, a Texas limited liability company. By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.
You must be at least 13 years old to use the App. If you are under 18, you must have permission from a parent or legal guardian.
You are responsible for maintaining the security of your account and password. You agree to provide accurate information when creating an account and to keep it up to date. You are responsible for all activity that occurs under your account.
You may not share your account with others, sell your account, or use someone else's account without permission.
Without a subscription, you have access to the first lesson, the full dictionary, the kana reference, and up to five flashcard decks that you create yourself. Lesson-generated decks, Tomodachi-generated decks, the remaining lessons, and the conversation features require an active subscription.
Gogaku is offered as a monthly or annual auto-renewing subscription. Current pricing is displayed in the App before purchase. Payments are processed by Apple via the App Store. By purchasing a subscription, you authorize Apple to charge the payment method on file.
New subscribers may be offered an introductory free trial. If you do not cancel before the trial period ends, the subscription converts to a paid subscription at the then-current price. Trial availability and length are shown in the App at the point of purchase, and promotional pricing may be offered from time to time in place of a trial.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. You can manage and cancel subscriptions in your Apple Account settings.
Refund requests are handled by Apple in accordance with Apple's App Store refund policy. We are not able to issue refunds directly.
We may change our pricing from time to time. Existing subscribers will be notified of price changes in advance and may cancel before the new price takes effect.

The in-app conversation and tutoring features are powered by a third-party large language model provided by OpenAI, L.L.C. Responses are generated automatically and may occasionally be inaccurate, incomplete, or inappropriate. Generated output should be treated as a learning aid, not as authoritative instruction. You are responsible for verifying important information through other sources.
Do not share sensitive personal information, financial details, passwords, or confidential data through the conversation features. See our Privacy Policy for how these messages are processed.
The App, including its lessons, dictionary entries, design, code, and branding, is the property of Philomath Tech LLC and is protected by copyright and other intellectual property laws. You may use the App for personal, non-commercial language learning. You may not copy, redistribute, or republish App content without permission.
You retain ownership of content you create within the App (for example, custom flashcard decks and notes). You grant us a limited license to store and process this content as necessary to provide the App's features.
You may delete your account at any time from within the App. We may suspend or terminate your account if you violate these Terms or attempt to harm the service or other users. Upon termination, your access to paid features ends, though you may still request data export or deletion as described in our Privacy Policy.
The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that any errors will be corrected. We do not guarantee any specific language-learning outcome.
To the maximum extent permitted by law, Philomath Tech LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App. Our total liability for any claim related to the App will not exceed the amount you paid us in the twelve months preceding the claim, or $50, whichever is greater.
We may update these Terms from time to time. If we make material changes, we will notify users through the App or by email. Continued use of the App after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law provisions.
